Courting Pretrial Justice Reform: Implications of Bail Litigation for Stakeholders & Policymakers
In crafting pretrial policies and practices, desired outcomes include protecting safety, maintaining employment, and preserving families. And every policy and practice must be consistent with constitutional principles, including the presumption of innocence, due process, and equal protection. Many pending lawsuits are seeking to vindicate these principles, with rulings that have already resulted in major changes in jurisdictions from Houston to Philadelphia. As many of these cases percolate in courts around the country, we will explore how jurisdictions can avoid litigation and pro-actively improve their pretrial systems to ensure they are legal, effective, and fair.
